Terms and Conditions and Privacy Notice
Event: Cloud Mastery Date: Thursday, 26th June 2025 Location: The Social House, 154 James Gichuru Road Organized by: Pawa IT Solutions Limited, 1st Floor George Padmore Ridge, George Padmore Road, Nairobi, Kenya ("Organizer")

1. Acceptance of Terms & Conditions

By registering for and/or attending Cloud Mastery ("Event"), you ("Attendee", "You", "Your") agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not register or attend the Event.

2. Registration and Payment

  1. Registration is confirmed only upon receipt of full payment of the applicable registration fee.
  2. Fees are as stated on the Event registration page/form and are payable in Kenya Shillings via online card payments or mpesa.
  3. Registration fees include: full day training session, training materials, meals (2 tea time snacks, 3 course lunch, bitings and refreshments (non-alcoholic and alcoholic).
  4. Registration fees exclude: travel, accommodation, visa costs, personal expenses, additional meals not specified.

3. Cancellation and Refund Policy

  1. No refunds will be issued for cancellations requests upon full payment for the event or for no-shows.
  2. Substitutions of attendees may be permitted at the Organizer's discretion if requested in writing at least Seven (7) days prior to the Event.
  3. The Organizer reserves the right to cancel or postpone the Event due to unforeseen circumstances (including but not limited to force majeure, low enrollment, or speaker unavailability).
  4. In the event of cancellation by the Organizer, Attendees will receive a full refund of their registration fee.
  5. In the event of postponement, Attendees will be offered registration for the rescheduled date or a full refund.
  6. The Organiser is not liable for any other costs incurred by the Attendee as a result of such cancellation or postponement (e.g., travel or accommodation expenses).

4. Code of Conduct

  1. Attendees are expected to conduct themselves professionally and respectfully at all times.
  2. Harassment, discrimination, or any disruptive behavior towards other attendees, speakers, staff, or hotel personnel will not be tolerated.
  3. Attendees must comply with all rules and regulations of Social House and all applicable laws.
  4. The Organizer reserves the right to remove any Attendee from the Event without refund if their behavior is deemed inappropriate, disruptive, or in violation of this Code of Conduct.
  5. Attendees are responsible for any damage caused by them to the hotel property or Event equipment.
  6. No attendees below the age of eighteen are permitted to attend the event

5. Intellectual Property

  1. All intellectual property rights in and to the training materials, presentations, and content provided during the Event are and shall remain the property of the Organizer or its licensors.
  2. Attendees are granted a limited, non-exclusive, non-transferable license to use the training materials for their personal educational purposes only.
  3. Recording (audio or video) of sessions is strictly prohibited without prior written consent from the Organizer. Photography may be permitted for personal, non-commercial use, subject to speaker approval and the Media Acceptance clause below.

6. Liability and Disclaimer

  1. The Organizer will endeavor to ensure the Event is delivered as advertised, but reserves the right to make changes to the program, speakers, or venue if necessary.
  2. Views expressed by speakers are their own. The Organizer does not accept liability for any advice given or views expressed during the Event.
  3. To the fullest extent permitted by law, the Organizer shall not be liable for any loss, damage, injury, or expense (direct, indirect, or consequential) suffered by any Attendee or their property, however caused, arising from participation in the Event, except for death or personal injury caused by the Organizer's gross negligence.
  4. Attendees are responsible for their own personal belongings. The Organizer and The Social House are not responsible for lost, stolen, or damaged items.

7. Data Privacy Policy

  1. What Information We Collect:
    • Registration Data: Your name, email address, company affiliation, and any other information you provided during registration for this training.
    • Event Participation: Attendance records, questions you ask, feedback you provide, and potentially your image if photos or videos are taken (see section 8. Media Acceptance).
    • Technical Data): During use specific lab environments we provide, anonymized or aggregated usage data might be collected for training improvement purposes.
  2. How We Use Your Information:
    • To manage your participation in this training event.
    • To provide you with training materials and resources.
    • To communicate with you about this event (e.g., schedule changes, follow-up materials).
    • To gather feedback to improve future training sessions.
  3. Data Sharing:
    • We do not sell your personal information.
    • We will share your information during interactions with third-party cloud platforms (GCP) during hands-on labs are subject to those platforms' respective privacy policies.
  4. Data Security & Retention:
    • We take reasonable measures to protect your personal information.
    • Information specifically related to this event will be retained only as long as necessary for the purposes outlined above or as required by law.
  5. Your Choices:
    • If you have provided information for optional communications (e.g., future newsletters) and wish to opt-out, please let us know or use the unsubscribe link provided.

8. Media Acceptance (Photography, Videography, and Audio Recording)

  1. By attending the Event, you acknowledge and agree that the Organizer (and/or its authorized representatives) may take photographs, video recordings, and/or audio recordings of the Event proceedings, sessions, and social activities, which may include your image, likeness, voice, and participation ("Media").
  2. You hereby grant the Organizer a worldwide, perpetual, irrevocable, royalty-free, non-exclusive license to use, reproduce, distribute, display, edit, and create derivative works from the Media, in whole or in part, in any and all media now known or hereafter devised, for promotional, marketing, educational, archival, or any other legitimate business purposes of the Organizer.
  3. This includes, but is not limited to, use on websites, social media platforms, brochures, newsletters, press releases, and future event promotions.
  4. You waive any right to inspect or approve the finished product or the advertising copy or other matter that may be used in connection therewith or the use to which it may be applied.
  5. You release and discharge the Organizer, its officers, employees, agents, and assigns from any and all claims, demands, liabilities, actions, causes of action, costs, and expenses whatsoever, at law or in equity, known or unknown, anticipated or unanticipated, which you ever had, now have, or may, shall, or hereafter have for, upon, or by reason of any matter, cause, or thing whatsoever arising out of or relating to the use of the Media as described herein.
  6. If you do not wish to be included in such Media, you must notify the Organizer in writing at events@pawait.co.ke prior to the Event. While the Organizer will make reasonable efforts to accommodate such requests, it may not always be possible to exclude individuals from group shots or general event coverage.

9. Force Majeure

The Organizer shall not be liable for any failure or delay in performing its obligations under these Terms & Conditions if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, labor disputes, pandemics, epidemics, government restrictions, or failure of public utilities or transport networks.

10. Amendments

The Organizer reserves the right to amend these Terms & Conditions at any time. Any amendments will be effective immediately upon posting on the Event website or notification to Attendees.

11. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising out of or in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of Kenya.

12. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.

13. Entire Agreement

These Terms & Conditions, along with the registration form and any event-specific rules provided, constitute the entire agreement between the Attendee and the Organizer concerning the Event and supersede all prior communications, understandings, and agreements.

By completing the registration for the Cloud Mastery Training, I acknowledge that I have read, understood, and agree to be bound by these Terms & Conditions, Privacy Notice including the Media Acceptance clause.
